In this latest edition of our Workplace Privacy Update, we explore developments in employee monitoring and surveillance, data subject access rights and standards on data retention.

Employee rights remain a key focus in workplace privacy, with clarification in Italy that data subjects are entitled to copies of data they already have access to, while a bank has been fined for delays in responding to requests. Regulators across Europe and Brazil have also taken action on employee monitoring, including fines and reprimands for video surveillance, geolocation tracking, and intrusive hiring practices. Meanwhile, recent rulings in Poland and Slovakia challenge the use of legitimate interest to justify retaining employee data post-employment. Finally, in the UK, the long awaited Data (Use and Access) Bill has finally passed and is awaiting Royal Assent.
