What will change in employment law in Slovenia in 2020? This article provides guidance for employers.

As of 1 January 2020, there will be changes in the areas set out below.

Minimum salary

The definition and the amount of the minimum salary will be modified. In 2020, the minimum salary will be EUR 940.58 gross (in 2019 it was EUR 886.63 gross). As far as the definition of the minimum salary is concerned, as of 1 January 2020, the minimum salary will no longer include: allowances provided by laws, regulations and collective agreements, including seniority allowance; any proportion of the salary that is performance-related and any payment relating to business performance.

Minimum hourly rate for student work

In 2020, the minimum gross hourly rate for student work will be EUR 5.40 (in 2019 it was EUR 4.89).

Regulation of temporary and casual work by retired people

According to a modification of the Slovenian Labour Market Regulation Act, an insured person over the age of 58 and with an insured period of more than 28 years is entitled to 25 months’ financial compensation.

A proposal for more flexible arrangements for temporary or casual work by retired people has been adopted.

More flexibility has been introduced into the restrictions on the time component of work by retired people. In addition, the number of employees an employer must have for restrictions on work by retired people each calendar year to apply has been increased. Based on these amendments, employers will no longer need the consent of the Ministry of Labour, Family, Social Affairs and Equal Opportunities to increase the number of hours worked by retired people for employers with more than 1,250 employees.

Sick leave certificate

It is anticipated that by 1 January 2020, all doctors will only issue e-sick leave certificates. Employers will have to pick them up electronically from February 2020 onwards. This means the employer will no longer have to wait for an employee to bring in a sick leave certificate, but will take over this process for employees.

Work inspections and recording for small and micro enterprises

A work inspection campaign is envisaged for small and micro enterprises (relating to recourse, payments and record-keeping under the law on records in the field of part-time work), and changes have also been proposed in the recording of working hours.
