How does the new French curfew work? A brief guide

France has imposed a curfew in the Paris region and in eight other cities from 17 October for six weeks. This article sets out how it works, what are the potential penalties for failing to comply and how employees are affected.

Which areas are included in the curfew?

The curfew is in place from 21:00 to 6:00, for a period of six weeks.

Since 24 October 54 departments (out of 101), in addition to French Polynesia, are covered by the curfew.

Are employees travelling for work exempt?

There is a derogation for travel between home and work (the place where professional activity is carried out) or a place of education and training, which is authorised.

As during lockdown, employees must be in possession of a certificate for these journeys.

The Ministry of the Interior has put the following on line:

  • A template certificate for exceptional travel.
  • A template proof of business travel, to be completed by the employer for each employee concerned. It is specified that it is not necessary for the employee to carry the ‘exceptional travel’ certificate addition to this document.

 

The travel certificate is also available in digital format.

 

Penalties

The Interior Ministry has stated that failure to observe the curfew will result in the following penalties:

  • First penalty: a fine of EUR 135, increased to EUR 375 in the event of non-payment or non-contestation within the time limit stated on the penalty notice.
  • In the event of a repeat offence within 15 days: a fine of EUR 200, increased to EUR 450 in the event of non-payment or non-contestation within the time limit stated on the penalty notice.
  • After three offences in 30 days: a fine of EUR 3750 and up to six months’ imprisonment.
